Texas housing agency introduces new compliance tools for multifamily property owners

The Texas Department of Housing and Community Affairs (TDHCA) has introduced several new resources aimed at simplifying the multifamily compliance process for properties it monitors. The tools are intended to support property owners and managers in meeting affirmative marketing and tenant selection criteria requirements.

Among the resources is an updated Multifamily Affirmative Marketing Tool, which offers a mapping feature to help identify populations least likely to apply for housing. This tool now includes details for individual TDHCA-monitored properties and allows users to search by city, zip code, or street address. It also comes with updated instructions and guidance on completing HUD 935.2A forms. The tool can be accessed at https://www.tdhca.texas.gov/MF-Affirmative-Marketing-Tool.

TDHCA has also released a Simplified Affirmative Marketing Plan Form. This form is designed for properties participating in TDHCA programs that do not require the HUD 935.2A form. According to the department, “the form follows TDHCA’s affirmative marketing rules and includes only items required under those rules.” The simplified version is less than two pages long, compared to the 12-page HUD form. Additional tools include an Affirmative Marketing Checklist and a Written Policies and Procedures/Tenant Selection Criteria Checklist. These checklists use yes/no questions to help staff preparing plans or policies identify areas of non-compliance with TDHCA rules and common errors that may occur in these documents. “These updates are designed to help property owners and managers remain compliant with TDHCA’s affirmative marketing and written policies and procedures rules, and significantly lower administrative burden without sacrificing protections for tenants and applicants at TDHCA-monitored properties,” according to the department.
